The website is managed and maintained by Association representatives; by the Association’s Rental Agent, Maui Lodging Properties LLC (“MLP”) (https://mauilodging.com); and by MLP employees. The website provides information about vacation rental units belonging to members of the Association and located at the Association’s physical address. Our website address is: https://honokeana.net. We manage rentals through the “Booking Website” (https://bookhonokeana-cove.escapia.com) and linked addresses. The Booking Website is operated by Escapia (https://software.homeaway.com), a subsidiary of HomeAway (https://homeaway.com). The HomeAway privacy policy appears at https://www.homeaway.com/info/about-us/legal/privacy-policy. We maintain a page on Facebook (https://www.facebook.com/mauiturtlecove) which shares information with our website. Hawaii taxes on rentals are paid by Honokeana Cove Rental Association TAT#W23778043-01 through MLP.

What personal data we collect and when we collect it

If you visit our physical address and allow yourself to appear in any images or videos, you are giving the photographer permission to use those images as the photographer may choose. When a photographer makes images or videos available to the Association, its members, employees or officers, the Association acquires the right to use that material on its Facebook page (https://www.facebook.com/mauiturtlecove), its website (https://honokeana.net) and in materials promoting our vacation rentals. The photographer may withhold our right to use images by so specifying when we receive them. You may avoid appearing in images that we use by not allowing your photo to be taken on our property. To request removal of any image we are using, see the later section “What rights you have over your data.”

If you provide images or videos to us for use on the website, you may wish to not provide images with embedded location data (EXIF GPS) included. Otherwise, if you include location data, visitors to the website can download and extract any location data from images on the website.

Privacy Policy – Rental Office / Rental Agent

If you contact the Association’s Rental Office or Rental Agent to request information about vacation rentals, you may provide us with personal information such as name, e-mail address, phone number and number of adult and minor guests. We will maintain that information unless you ask us to delete it. And we may use that information to contact you once in a while unless you ask to be taken off our mailing lists. Also, we may enter your personal information into the Booking Website to keep you on our contact list and to assist you with current or future bookings.

Sharing with Condominium Owner

If you are a past or future guest at the Association’s property address, you will be renting a condominium belonging to an individual owner who has joined the Association. Therefore, the owner of that condominium is a party to the agreement that secures your vacation rental. Because our owners sometimes like to contact their guests, upon request by the condo owner we will share contact information for that condo’s past and future guests.

Credit Card Information

If you make a reservation with the Association, we may ask you for credit card information to process a deposit and to pay for your rental. The credit card information that you enter into the Booking Website applies only to the current transaction. The website does not store it. Moreover, credit card information used by the rental office is not given to the condominium owner.

What rights you have over your data

If you submit information to this website you can request to receive a copy of whatever data we retained. And we will make a reasonable good faith effort to find all of that data. Also, you can request that we erase any personal data we hold about you. This does not include any data we must keep for administrative, legal, or security purposes.

If you recognizably appear in an image or video we are using, or if you believe that you own that image or video, you may contact us (see “Who we are” above) and request that we no longer publicly display it. Please provide enough information that we can clearly identify the image in question, and explain the basis for your request. If your request appears valid, we will make a reasonable good faith effort to locate all copies of that image or video that are under our control, and remove them from our publicly available materials..
